Overview
Welcome to NIXOFY. The terms "we", "us" and "our" refer to NIXOFY, a brand operated by Ana Catarina de Freitas Diogo, a sole trader (Empresária em Nome Individual, ENI) with tax number (NIF) PT217375251, with business address at Av. do Atlântico, Edifício Panoramic, n.º 16, 14.º Piso, Escritório 8, Parque das Nações, 1990-019 Lisboa, Portugal.
NIXOFY operates this online store and website, including all related information, content, features, products and services ("Services"). The store is built on Shopify technology.
The terms and conditions below, together with the Privacy Policy, Returns Policy and Shipping Policy, set out your rights and responsibilities when using the Services. Please read them carefully before using the site.
By visiting, interacting with or buying from NIXOFY, you agree to be bound by these Terms of Service.
1. Access and Account
By agreeing to these Terms, you declare that you are at least 18 years old or of legal age in your country of residence.
To use the Services you may need to provide information such as your name, email, delivery address and payment details. You declare that all information provided is true, current and complete. You are responsible for keeping your account credentials secure.
2. Our Products
We make every effort to present accurate images and descriptions of our products. However, the perception of colour, texture or size may vary depending on your screen and lighting. Many items are made by small producers on a small scale, so slight variations between pieces are normal and part of their handcrafted character.
All descriptions are subject to change without notice, without prejudice to orders already accepted. We reserve the right to discontinue products at any time or to limit the quantities available.
3. Orders and Acceptance
An order is an offer to buy. NIXOFY reserves the right to accept or refuse any order at its discretion, in particular in cases of:
- Product unavailability
- Obvious error in price or description
- Suspected fraudulent use
An order is only considered accepted after confirmation by email and processing of the payment.
4. Prices and Payment
All prices shown in the store are in euros (€) and include VAT at the legal rate in force (23%) and any other applicable taxes. For deliveries to mainland Portugal, peninsular Spain and France, shipping is free and already included in the price shown.
Prices may change without notice. The applicable price is the one in force at the time the order is submitted and that appears in the order confirmation.
The payment methods available may vary by country and are shown at checkout, before the order is confirmed. By entering your payment details, you declare that you are authorised to use the chosen payment method.
5. Invoicing
Invoices are issued automatically after payment is confirmed and sent by email. To receive an invoice with a company tax number (NIF), send your request to suporte@nixofy.com after your purchase, stating the order number, the tax number and the company name. Invoices are issued through software certified by the Portuguese Tax Authority (Autoridade Tributária) (InvoiceXpress).
6. Shipping and Delivery
Delivery times are estimates and may vary depending on the supplier and the carrier. We are not responsible for delays caused by third parties (carriers, customs, extraordinary events) beyond our reasonable control.

7. Right of Withdrawal and Returns
You have a 14-day right of withdrawal, in accordance with Decree-Law no. 24/2014 and EU consumer law. See the Returns Policy for the detailed procedure.
8. Guarantee
All products carry a legal guarantee of conformity of 3 years from the date of delivery, in accordance with Decree-Law no. 84/2021 (which transposes Directive (EU) 2019/771). During the first 2 years any lack of conformity is presumed to have existed at delivery, so you do not have to prove it. During the first 30 days after delivery you may also exercise the right of rejection and immediately request replacement of the item or termination of the contract. The guarantee covers manufacturing defects and lack of conformity, but does not cover normal wear and tear, improper use or damage resulting from incorrect handling.
9. Intellectual Property
The content of this store (texts, images, logos, design) is the property of NIXOFY or used with the permission of the respective owners, and is protected by national and European copyright and industrial property law. You may not reproduce, copy or distribute the content without prior written permission.
The "NIXOFY" brand and its logo are the property of the company and may not be used without permission.
10. Privacy and Cookies
The processing of your personal data is governed by our Privacy Policy and Cookie Policy. By using the store, you acknowledge that you have read and accept these policies.
11. Electronic Complaints Book
In compliance with Decree-Law no. 74/2017, we provide access to the Electronic Complaints Book (Livro de Reclamações Electrónico) on our dedicated page. Alternatively, you can submit a complaint directly at www.livroreclamacoes.pt. For a cross-border purchase, you can also ask the European Consumer Centre in your country for guidance.
12. Out-of-Court Dispute Resolution
Where applicable, consumers may turn to an alternative consumer dispute resolution body. In Portugal, the competent body is CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt).
13. Prohibited Uses
You may not use the store for unlawful purposes, to infringe the rights of third parties, to transmit malicious content, to attempt to bypass security measures or to collect data about other users. We reserve the right to suspend or remove the access of anyone who breaches these terms.
14. Limitation of Liability
Nothing in these Terms limits the consumer's non-waivable rights or excludes liability that cannot legally be excluded. To the extent permitted by law, NIXOFY is not liable for indirect damage resulting from events beyond its reasonable control.
15. Changes to the Terms
We reserve the right to update these Terms at any time. Changes take effect on the date of publication and do not affect orders already placed.
16. Governing Law and Jurisdiction
These Terms are governed by Portuguese law, without prejudice to the mandatory consumer protection rules that apply in the customer's country of residence. The competent court is determined in accordance with the rules applicable to consumer contracts.
